Terms of Service

Section 1 Scope
These Terms of Service apply to all contracts between Oliver Grimm (hereinafter the "Provider") and users of the GameHub Bot service (hereinafter the "User") via the Provider's website.
Section 2 Description of Services
GameHub Bot is a Discord bot service that provides features such as a welcome system, rules management, timer messages, and player tools for Discord servers. The service is provided over the internet as Software as a Service (SaaS).
The Provider may modify, expand, or discontinue individual features if there is a valid reason for doing so, such as changes to the technical framework, adjustments required by Discord, security or legal requirements, or further development of the service, provided that the change is reasonable for the User. Material changes to paid services will be announced to the User in text form, such as by email, with reasonable prior notice. If a change impairs the User more than insignificantly, the User has a special right of termination under Sections 327r and 308 No. 4 BGB.
Section 3 Conclusion of Contract and Registration
Registration takes place via Discord OAuth 2.0. By registering, the User declares that they have read and accepted these Terms of Service and the Privacy Policy. The contract is formed when the account is activated.
Section 4 Prices and Payment
- Free Plan: Free of charge, with no contractual commitment.
- Premium Plan: EUR 2.99 / month or EUR 29.90 / year. Cancelable monthly or yearly, respectively.
- Platinum Plan (5 years): EUR 125.00 one-time payment. Not a subscription; this is a fixed-term access package with a term of five (5) years from the conclusion of the contract. Access ends automatically after expiry without requiring cancellation.
All prices are final prices in euros. Pursuant to Section 19 UStG (small business regulation), no VAT is charged or shown. Payment is processed via Stripe. Monthly and yearly Premium subscriptions automatically renew for the same term unless canceled in due time; see Section 6 for cancellation options.
Section 5 Right of Withdrawal
Consumers generally have a 14-day right of withdrawal. In the case of digital services, the right of withdrawal may expire prematurely if the User expressly agrees that the Provider may begin performing the contract before the withdrawal period expires and the User confirms their knowledge that, by giving this consent, they lose their right of withdrawal once performance begins (Section 356 (4) BGB). If the consumer exercises the right of withdrawal after performance has already begun at their request, they owe proportionate compensation for the services provided up to the withdrawal (Section 357 (8) BGB).

Section 6 Cancellation
The monthly Premium Plan may be canceled at any time effective at the end of the current billing period. The yearly Premium Plan may be canceled effective at the end of the initial contract term of one year. If it is not canceled and renews automatically, it may be canceled during the renewal phase at any time with one month's notice pursuant to Section 309 No. 9 BGB. The Platinum Plan is a one-time fixed-term access package lasting five years; it ends automatically after five years and does not require cancellation. Early termination of the Platinum package is not provided for; the statutory right of withdrawal under Section 5 and any mandatory statutory termination rights remain unaffected.

The Provider may terminate the contract without notice if the User violates these Terms of Service.
Section 7 Terms of Use
The User undertakes:
- not to use the service for illegal purposes
- to comply with Discord's terms of use
- not to distribute automated attacks or spam via the bot
- not to distribute content that violates applicable law
Section 8 Limitation of Liability
The Provider shall be liable without limitation for damages arising from injury to life, body, or health caused by negligent or intentional breach of duty, as well as for other damages caused by intentional or grossly negligent breach of duty by the Provider or its vicarious agents.
In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations, the fulfillment of which is essential for the proper performance of the contract and on whose compliance the User may regularly rely), liability shall be limited in amount to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
Liability under the German Product Liability Act and under any expressly assumed guarantee remains unaffected. The Provider is not liable for damages outside its sphere of influence, particularly outages of the Discord service, force majeure, or misuse of the bot by the User. Service availability is provided on a best-effort basis.
Section 9 Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
Statutory places of jurisdiction apply to consumers. No special place of jurisdiction at the Provider's registered office is agreed for consumers. If the User is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the Provider's registered office.
